The government has issued guidance after 2 clients won their cases in the Supreme Court against the bedroom tax. '...The Court declared that Mrs Carmichael (the fth ‘MA’ case who cannot share a bedroom with her husband because of her disabilities) and the Rutherfords (the grandparents of a severely disabled child who need an additional room for the child’s overnight carer) had suffered disability discrimination contrary to Article 14 of the European Convention on Human Rights...The Department is considering the Court’s judgment and will take steps to ensure it complies with its terms in due course.'

There is a worry that the government may respond by saying the cost in these two cases can be met by Discretionary Housing Payments.

Similar clients should keep an eye on what the government's response will be and respond accordingly.
